Last year, Joe Biden nominated Melissa Holyoak and Andrew Ferguson as commissioners to the FTC. Ferguson served as McConnell’s Chief Counsel, putting the Republican Senate leader completely on board with Biden’s nominations. Previously, Holyoak worked as an attorney for a D.C. think tank named the Competitive Enterprise Institute. CEI is essentially a tech lobbying group funded by Google and Facebook. Other funders of CEI include the Koch Network, which has endorsed Nikki Haley. Unsurprisingly, CEI has come out against President Trump’s most essential policies regarding tariffs and big tech.
Melissa Holyoak’s former employer, CEI, criticized President Trump following a lawsuit he filed against Facebook and Twitter for removing him while he was the sitting President of the United States. CEI’s statement read, “These social media platforms are private property, not the government town square, and are well within their First Amendment rights to refuse to carry speech of third parties. This principle holds even with the former President of the United States and is the constitutional right of every citizen.” The CEI statement continued reading, “This lawsuit is a publicity stunt intended for political gain, not a serious legal argument.”
In 2019, following President Trump’s announcement that his DOJ would proceed with an anti-trust crackdown against Google, Facebook, and Amazon, CEI released a statement titled: “Trump DOJ Wrong to Persecute Big Tech With Antitrust.” CEI’s statement praised big tech, reading, “The Department of Justice should stand down from investigating these dynamic and innovative technology companies.”
CEI was also against Trump’s America First tariffs. When Trump announced he was evening the trading scales with China, CEI criticized him for this with an article titled, “CEI Warns Trump China Tariffs Will Backfire.” In the article, CEI called on Congress to “stop President Trump’s dangerous, unilateral protectionism.”
Unsurprisingly, CEI has come out against Trump’s 10% tariff pledge he has promised to enact if he is reelected. CEI shared an article on their website titled, “10% tariff, 100% bad idea.”
Most disturbingly, CEI’s January 6th assessment shares the liberal media and Democrats’ lie that five police officers were killed that day with their statement reading, “Five people died in a coup attempt at the U.S. Capitol, over obviously false claims of a stolen election. It is important to understand what causes this behavior in order to prevent future violence, and to prevent a future breakdown of liberal institutions.”
Holyoak’s confirmation status is currently “Placed on Senate Executive Calendar. Calendar No. 363. Subject to nominee’s commitment to respond to requests to appear and testify before any duly constituted committee of the Senate.” This means testimony could be coming soon before a confirmation vote.
Mitch McConnell has reason to support and push Holyoak’s nomination as his former Chief Counsel Andrew Ferguson is also on Holyoak’s nomination slate.
